Serbian conformity mark and CE mark for machinery under MD

In accordance with the Rulebook on safety of machinery („Official Gazette of the RS“, No. 58/16 and 21/20), hereinafter: Rulebook, the manufacturer, before placing the machine on the market and/or in use, among other things, has the obligation to place the mark of conformity on the machine, in accordance with Article 12 of this Rulebook. 

It is considered that the machine on which the mark of conformity is placed and which is accompanied by the Declaration of conformity of the machine is in conformity with the requirements of this Rulebook. If a certain machine is subject to other regulations on the basis of which other issues are regulated and according to which the placing of the mark of conformity is prescribed, the placed mark of conformity means that the machine is also in compliance with the requirements of those other regulations.

The appearance and content of the mark of conformity ("CE" and „Serbian mark of conformity“) is described in Annex 3 of the Rulebook.

The mark of conformity is placed on the machine so that it is visible, legible and indelible, and if this is not possible, it is placed on its packaging or accompanying documentation.

Exceptionally, if the manufacturer or his representative is not registered on the territory of the Republic of Serbia, the importer places the mark of conformity on the machine, or if this is not appropriate, places it on its packaging and/or accompanying documentation.

CE marking – The CE marking in the EU represents the only permitted marking indicating product compliance with the requirements of European directives regarding product safety. The CE marking on a product represents the manufacturer's declaration that the product meets the essential requirements of relevant European legislation (concerning health, safety, environmental protection), and in practice, with the requirements of the directives regulating specific products.

The CE marking is a mandatory European marking for product groups and indicates compliance with the basic safety and health requirements of the new approach directives. 

The CE marking should be placed only on products for which it is prescribed according to specific European directives and must not be placed on other products. Additionally, it is prohibited to mark products with signs that could resemble the CE marking and thus mislead consumers.

The CE marking on a product is not a quality mark, but it is a confirmation to supervisory bodies that the product can legally be placed on the market.

CE ensures the free movement of products within the European Union and EFTA. Manufacturers who wish to market their products in the European market must ensure that their products comply with the Machinery directive requirements and bear the CE marking. With this marking, manufacturers/distributors demonstrate that their product complies with the applicable safety standards and can be freely placed on the market within the European Union.

In accordance with Article 18, paragraph 2 of the Rulebook, from the date of entry into force of the ACAA agreement (ACAA – Agreement on Conformity Assessment and Acceptance of Industrial Products) for machinery to which this Rulebook applies, or from the date of accession of the Republic of Serbia to the European Union, the conformity marking of machinery is carried out by placing the CE marking in accordance with this Rulebook and specific regulations.

Serbian Mark of Conformity

The conformity of products with the essential requirements of Serbian technical regulations is indicated by the placement of the Serbian Mark of Conformity on the product. 

The Serbian Mark of Conformity is the sole mark that confirms a product placed on the market or into use in the Republic of Serbia complies with the requirements of the Serbian technical regulation, if the regulation mandates its placement.

For users in the Republic of Serbia, it is important to note that the CE marking does not replace the Serbian Mark of Conformity. The Serbian Mark of Conformity, in accordance with the technical regulation, must always be placed on products marketed or used in Serbia, regardless of whether the product already bears the CE marking. This means that both marks can be placed on the same product. 

The Serbian mark of conformity is placed by the manufacturer, i.e. his representative or the importer if it is determined by the technical regulation, after the conformity assessment has been carried out. He does this independently or on the instructions of the designated body that conducted the conformity assessment. Based on the Certificate of Conformity or an extract from the records of the designated body on issued certificates, the manufacturer or his representative, i.e. the importer places the Serbian mark of conformity on the machine.

The Serbian Mark of Conformity consists of three capital letters "A" connected in the shape of an equilateral triangle (3A). Alongside the Serbian Mark of Conformity, the registration number of the notified body from the register of notified bodies for conformity assessment, as well as the last two digits of the year of issuance of the conformity document, are placed if that body conducted or participated in the conformity assessment. The shape, appearance, and content of the Serbian Mark of Conformity are regulated by the Decree on the Conformity Mark (“Official Gazette of RS”, No. 04/22). The Serbian Mark of Conformity is placed in the following order:

  1. On the product;
  2. On the nameplate of the product;
  3. On its packaging, or on a label or tag attached to the packaging of the product;
  4. On the accompanying documentation of the product.

The rule is that the Serbian Mark of Conformity should be placed on the product in an easily accessible location for inspection. This mark must remain intact in case of further processing, modification, or when the product (or parts of it) is integrated into other products or installations.

Exceptionally, if it is not possible to place the Serbian Mark of Conformity on the product due to its nature, dimensions, or other characteristics that prevent this, the mark can be placed on the nameplate or a tag attached to the product.

In accordance with Article 18, paragraph 2 of the Rulebook, from the date of entry into force of the ACAA agreement (ACAA – Agreement on Conformity Assessment and Acceptance of Industrial Products) for machinery to which this Rulebook applies, or if that agreement is not concluded, from the date of accession of the Republic of Serbia to the European Union, the conformity marking of machinery is carried out by placing the CE marking in accordance with this Rulebook and specific regulations.
